Title:Evalvacija vpliva probacijske službe na povratništvo in zaporsko populacijo v Republiki Sloveniji

Abstract:Porast kriminala je mednarodni problem. Zaradi tega se več kot polovica evropskih držav srečuje oziroma spopada s problematiko prezasedenosti zaporov. Na zaporsko populacijo v veliki meri med drugim vpliva tudi povratništvo, saj je delež povratnikov med vsemi obsojenci lahko tudi 50-odstotni. V boju proti povratništvu in posledično zmanjšanju prezasedenosti zavodov so bile ustanovljene probacijske službe. Slovenija je leta 2018 pridobila organ za probacijo. Namen naše naloge je bil, da skozi evalvacijo ugotovimo, ali je probacija v Sloveniji (ne)učinkovita in kakšen vpliv je imela na slovenski zaporniški sistem ter družbo. Raziskava je bila razdeljena na teoretični in empirični del. V teoretičnem delu smo predstavili delovanje javnih politik in njihove akterje. Predstavili smo tudi delovanje Uprave za izvrševanje kazenskih sankcij in Uprave za probacijo, ki delujeta znotraj Ministrstva za pravosodje. Poleg tega smo opredelili pojma povratništvo v kaznopravnem pomenu in zaporsko populacijo. Na koncu teoretičnega dela smo naredili primerjavo z ostalimi evropskimi državami. V empiričnem delu smo opredelili raziskovalni problem, tri zastavljene teze, namen in cilje naloge ter metodologijo. Za pomoč pri evalvaciji in doseganju ciljev naloge smo si zastavili tri teze in dve od njih potrdili. Probacija je pripomogla k zmanjšanju zaporske populacije in povratništva, vendar je v drugem letu izvrševanja zaključila manj kot plovico vseh nalog. Probacija prav tako ni dostopna vsem nekdanjim obsojencem. Če bi lahko rešili ti dve področji probacije, bi lahko opazili še boljše rezultate pri resocializaciji obsojencev in zmanjšanju števila povratnikov. Kljub temu pa lahko sklenemo, da je bila ustanovitev probacije pravilna odločitev.

Title:Evaluation of the impact of the probation service on Recidivism and prison population in the Republic of Slovenia
Abstract:The rise in crime is an international problem. As a result, more than half of European countries are facing the problem of prison overcrowding. The prison population is largely affected by recidivism, as the share of returnees among all convicts can be as high as 50%. Probation services have been set up to combat recidivism and reduce congestion. Slovenia acquired a probation body in 2018. The purpose of our task was therefore to determine through evaluation, whether probation in Slovenia is (in) effective and what impact it has had on the Slovenian prison system and society. The research was divided into theoretical and empirical part. In the theoretical part, we presented the operation of public policies and their actors. We also presented the operation of the Administration for the Execution of Criminal Sanctions and the Administration for Probation, who both operate within the Ministry of Justice. We also defined the concept of recidivism in the criminal sense and the prison population. At the end of the theoretical part we made a comparison with other European countries. In the empirical part, we defined the research problem, three set theses, the purpose and goals of the task and the methodology. To help in the evaluation and achievement of the objectives of the task, we set ourselves three theses and confirmed two of them. Probation has helped reduce the prison population and recidivism. However, probation administration completed less than half of all assignments in the second year of execution and is also not available to all former convicts. If these two areas of probation could be resolved, even better results could be observed in the resocialization of convicts and the reduction in the number of returnees. Nevertheless, we can conclude that setting up a probation system was the right decision.
