Title:Mediacija kot sredstvo mirnega reševanja mednarodnih sporov : diplomsko delo

Abstract:V svetu se je z razvojem civilizacije postopoma pojavila težnja po mirnem reševanju sporov. V osemdesetih in devetdesetih letih se je ta metoda reševanja sporov močno razširila tudi po vsej Evropi. Način reševanja sporov na miren način je dandanes dolžnost, ki jo morajo upoštevati vsi subjekti, ki so del mednarodnega prava – med njimi tudi države. To načelo je uzakonjeno v Ustanovni listini Organizacije združenih narodov, ta sredstva pa našteva tudi deklaracija načel mednarodnega prava o prijateljskih odnosih in sodelovanju med državama. V 33. členu Ustanovne listine OZN so določena diplomatska sredstva – pogajanja, posredovanje, dobre usluge, sprava in preiskava; odlikujejo jih hitrost, prilagodljivost in zaupnost. Njihov namen je pomoč pri doseganju soglasij med strankami in niso pravno zavezujoča, prav tako jih je mogoče kombinirati z drugimi pravnimi sredstvi. Meddržavni spori zadevajo glavne interese držav, njihovo čast in državno ozemlje. V kolikor državi dosežeta rešitev s pomočjo mediacije, to lahko pomeni ponovno vzpostavitev dobrega odnosa, zaupanja med njima, in zmanjša se možnost zaostrovanja sporov v prihodnje, kar je zelo pomembno za meddržavno sodelovanje. Odločitev za uporabo sredstev mirnega reševanja spora je suverena odločitev vsake države, mediator in njegova ekipa pa delujejo kot blažilec med sprtima stranema ter v postopek vnesejo zaupanje.

Abstract:With the development of civilization, a tendency to peacefully resolve disputes gradually emerged in the world. In the 1980s and 1990s, peaceful settlement of disputes spread widely throughout Europe. The method of resolving disputes amicably today is a duty that must be respected by all subjects of international law – including states. This principle is enshrined in the Charter of the United Nations, and these means are also listed in the Declaration of Principles of International Law on Friendly Relations and Cooperation between States. Article 33 of the UN Charter sets out diplomatic means – negotiations, bons offices, mediation, investigation and reconciliation; they are distinguished by speed, flexibility and confidentiality. They are intended to assist in reaching agreements between the parties and are not legally binding, but they can be combined with other remedies. Interstate disputes concern the main interests of the state, their honor and the territory of the state. If the two countries reach a solution through mediation, this can mean re-establishing a good relationship, trust between them and reduce the possibility of escalating conflicts in the future, which is very important for interstate cooperation. The decision to use the means of peaceful settlement of the dispute is a sovereign decision of each state, and the mediator and his team act as a buffer between the disputing parties and bring trust to the proceedings.
