Abstract:Definicija država ter mednarodno pravo sta tesno povezani, subjekt mednarodnega prava je država. Pravica do samoodločbe je pravica vsakega naroda in temeljno načelo mednarodno pravnega dokumenta. S samoodločbo dobi narod pravico, da ustanovi svojo lastno državo. Že sama beseda samoodločba pove vse - samo in odločba, da narod sam odloča. To je največja predmet konflikta med Marokom in Zahodno Saharo, ki se ne moreta dogovoriti, kdo ima in kdo nima pravice do samoodločbe. Za ozemlje Zahodne Sahare se borita Maroko, zmotno na podlagi teritorialnega načela, ter avtohtoni prebivalci Zahodne Sahare na podlagi kolonialne pravice o samoodločbi. Zahodna Sahara je bila nekoč kolonija Španije in je od leta 1960 na seznamu ne-samoupravnih ozemelj Združenih narodov. Organizacija združenih narodov že leta pomaga reševati zapleteno situacijo med dvema narodoma, ki oba zatrjujeta, da je ozemlje Zahodne Sahare njuno. Večina ozemlja je v rokah Maroka, ki je po merilih OZN okupacijska sila. Po dolgoletni vojni in po dolgoletnih mirovnih pogovorih se položaj ne izboljšuje. Osvobodilno gibanje Polisario, ki se bori za avtohtone prebivalce Zahodne Sahare, ima svoj sedež v Alžiriji. Ta sosednja država je veliki podpornik Polisaria. Polisario je ustanovil svojo lastno državo pod imenom Demokratična arabska republika Sahara.

Abstract:The definition of the state and international law are closely related. The object of international law is the state. The right to self-determination is the right of every nation and a fundamental principle of an international legal instrument. Through the right of self-determination, a nation acquires the right to establish its own state. The very word self-determination states that only the nation itself can decides for itself to create a new state. This is the biggest problem in the conflict between Morocco and Western Sahara. They can not decide who does and who does not have the right to vote for self-determination. They are fighting over the territory of Western Sahara, Morocco erroneously on the basis of territorial integrity and for the indigenous people of Western Sahara on the basis of the colonial right to self-determination. Western Sahara was once a colony of Spain and has been on the United Nations list of non-self-governing territories since 1960. The United Nations has been trying for years to resolve this complex situation between two nations, both of which claim the territory of Western Sahara. Most of the territory is in the hands of Morocco, which is an occupying by UN standards. After years of war and years of peace talks, the situation is not improving. The Polisario, a liberation movement fighting for the indigenous people of Western Sahara, in Algeria. This neighboring country is a big supporter of Polisaria, which has its headquarters in Algeria. Polisario established his own state the Democratic Arab Republic of the Sahara.
