Title:ICC in postopki v njenem okviru za reševanje sporov : diplomsko delo

Abstract:Mednarodno trgovinsko poslovanje je v 21. stoletju v svoji zlati dobi. Dostopnost dobrin iz celega sveta je vsakemu človeku trenutno samoumevna, da pa smo prišli do tega je v veliki meri zaslužna Mednarodna trgovinska zbornica, ki deluje kot zasebna organizacija, ki ščiti, spodbuja in zastopa interese podjetij na mednarodni ravni. Ob ekonomskih ciljih in blaginji za vse pa se njeno delo razteza tudi na alternativno reševanje sporov. Sodni procesi se postavljajo vse bolj na stranski tir in tako druge vrste reševanja sporov veljajo za privlačno, primerno, v velikih primerih pa tudi za primarno metodo v hitrem svetu, ki zahteva izkušenost, strokovnost in hitrost za rešitev spora. Najbolj znan institut je arbitražni postopek, kjer stranke pooblastijo arbitražni tribunal, da ta izda zavezujočo in izvršljivo sodbo za stranke. Temu pa sledijo tudi druge vrste mirnega reševanja sporov, ki so primerne za vsa področja kjer lahko med vsaj dvema strankama nastane spor. Sem spadajo mediacija, Odbori za spore, Izvedenstvo, predarbitražni postopek, DOCDEX postopki in Imenovanje avtoritete. Vsak od njih vsebuje svoje prednosti, ki omogočajo strankam, da se tako odločijo za tisto kar se jim zdi za njihov spor najbolj smotrno.

Abstract:International trade is in its golden age in the 21st century. The availability of goods from all over the world is currently self-evident to individuals and the International Chamber of Commerce, which acts as a private organization that protects, promotes and represents the interests of companies internationally, is largely resposnible for this. In addition to economic goals and prosperity for all, her work also extends to alternative dispute resolution. Litigation is increasingly being sidelined, which makes other types of dispute resolution attractive, appropriate and in large cases the primary method of solving disputes in a fast-paced world that requires experience, expertise and speed. The most well-known institute is the arbitration procedure, where the parties authorize the arbitral tribunal to issue a binding and enforcable award for the parties. This is followed by other types of alternative dispute methods, which are suitable for all areas where a dispute may arise between at least two parties. These include mediation, Dispute boards, Expertise, pre-arbitral referee, DOCDEX proceedings and Appointing Authority. Each of them contains its own advantages, which allow the parties to decide what they consider most appropriate for their dispute.
