Title:Begunski val leta 2015 v luči mednarodnega prava s poudarkom na konvenciji o statusu beguncev iz leta 1951 : magistrsko delo

Abstract:Magistrsko delo obravnava problem begunskega vala leta 2015 v luči mednarodnega prava s poudarkom na Konvenciji o statusu beguncev iz leta 1951. Temeljni zakon, ki ureja področje mednarodne zaščite v Republiki Sloveniji, je Zakon o mednarodni zaščiti. V njem je definiran pojem mednarodne zaščite, ki sicer pomeni status begunca ali status subsidiarne zaščite. Slovenija kot tudi EU stremi k vzpostavitvi skupnega evropskega azilnega sistema. Postopek mednarodne zaščite bi namreč moral biti za vse prosilce mednarodne zaščite hiter, pravičen in pošten. V magistrskem delu smo analizirali migracijsko in azilno politiko na ravni EU in probleme mednarodnega pravnega varstva tujcev v EU in Sloveniji. Razdeljeno je na več poglavij. V prvem delu predstavljamo obravnavno tematiko ter problem in predmet raziskovanja s postavljenimi hipotezami. Nadaljujemo z namenom in cilji raziskovanja, oceno že opravljenih raziskovanj ter metodami raziskovanja. V drugem delu, v teoretičnih izhodiščih, predstavljamo osnovne pojme, kot so: begunec, azil, prosilec za azil, tujec, varna tretja država, izvorna država … V tretjem sklopu smo na kratko opredelili pojem migracij, vrste in vzroke. Četrti in peti sklop sta namenjena opisu pravnih temeljev mednarodnega prava za zaščito azilantov/beguncev. V šestem in sedmem sklopu smo analizirali in ocenili primernost ukrepov aktivne azilne/begunske politike v Republiki Sloveniji na podlagi vključevanja azilantov/beguncev. V zaključku smo predstavili dosežene rezultate in cilje magistrskega dela, preverili hipoteze in predstavili prispevek rezultatov raziskave k stroki ter uporabnost rezultatov raziskave.

Abstract:The master's thesis deals with the refugee wave's problem in 2015 in the light of international law with an emphasis on the 1951 Convention relating to the Status of Refugees. The fundamental law governing international protection in the Republic of Slovenia is the International Protection Act. It defines the concept of international protection, which otherwise means refugee status or subsidiary protection status. In the master's thesis, we analyzed migration and asylum policy at the EU level and the international legal protection of foreigners in the EU and Slovenia. It is divided into several chapters. In the first part, we present the topic, the problem, and the research subject with the set hypotheses. We continue with the research's purpose and goals, the evaluation of already conducted research and research methods. In the second part, in theoretical starting points, we present the basic concepts such as: refugee, asylum, asylum seeker, foreigner, safe third country, country of origin … In the third part, we briefly define the concept of migration, types, and causes. The fourth and fifth sections are intended to describe international law's legal basis to protect asylum seekers/refugees. In the sixth and seventh sets, we analyzed and assessed the appropriateness of active asylum/refugee policy measures in the Republic of Slovenia based on asylum seekers/refugees' inclusion. In the end, we presented the achieved results and goals of the master's thesis, tested the hypotheses, and presented the research results' contribution to the profession and the applicability of the research results.
