Abstract:Državljanstvo Evropske unije, ki je bilo institucionalizirano z Maastrichtsko pogodbo, nadgrajuje nacionalno državljanstvo. Vsak državljan države članice je torej hkrati državljan Evropske unije. Iz tega koncepta izhajajo različne pravice in dolžnosti, ki jih moramo spoštovati tako državljani Unije kot njene države članice. Za pravno ureditev državljanstva Evropske unije sta pomembni primarna in sekundarna zakonodaja Evropske unije. To diplomsko delo pa ne spregleda obsežne sodne prakse Sodišča Evropske unije, na podlagi katere se je koncept državljanstva Evropske unije od uvedbe spreminjal in dopolnjeval praviloma v okviru postopka predhodnega odločanja. Na odločitve Sodišča Evropske unije in s tem na oblikovanje njegove sodne prakse ima po tem, ko je postala decembra 2009 pravno zavezujoča, pomemben vpliv tudi Listina Evropske unije o temeljnih pravicah. Državljanstvo Evropske unije in pravice, ki izhajajo iz tega koncepta, nam omogočajo boljše in kakovostnejše življenje tako poklicno kot zasebno, ne glede na to, ali smo v domači državi ali državi gostiteljici.

Abstract:Union citizenship, institutionalized by the Maastricht Treaty, builds on national citizenship. Every citizen of a Member State is therefore also a citizen of the Union. The concept of citizenship of the Union gives rise to various rights and duties which must be respected by citizens of both the Union and the Member States. Primary and secondary EU legislation are important for the regulation of Union citizenship. This final thesis does not overlook the extensive case-law of the Court of Justice of the European Union based on which the concept of the Union citizenship has been modified and supplemented within the preliminary reference procedure. The Charter of Fundamental Rights of the European Union has played an important role in the decisions of the Court of Justice of the European Union, and thus in shaping its case-law, since it became legally binding in December 2009. Citizenship of the Union and the rights that flow from this concept enable us to lead a better and more fulfilling life, both professionally and privately, whether we are in our home country or in a host country.
