Title:Pravna sredstva kot sredstva kontrole pravne pravilnosti upravnih in sodnih odločb : magistrsko delo

Abstract:Pravica do pravnega sredstva je temeljna pravica in je kot taka tudi del našega pravnega reda, torej tudi del našega upravnega prava. Pravni red na področju upravnega prava zagotavlja več različnih pravnih sredstev, ki stremijo k temu, da je na koncu izdana upravna odločba pravilna (zakonita in utemeljena z resničnim dejanskem stanjem). Pri tem se postavlja vprašanje, ali večje število pravnih sredstev povečuje pravno pravilnost in pravno varnost ali pa množica pravnih sredstev vnaša negotovosti v pridobljene pravice, če se odpirajo nove in nove možnosti izpodbijanja. Magistrsko delo je nastalo na podlagi analize konkretno izbranih primerov (spisov v upravnih zadevah), njen namen pa je bil ugotoviti, kakšen je vpliv odločitve drugostopenjskega organa na pravno pravilnost odločitve in nadalje na delo prvostopenjskega organa ter tudi, kakšen je pomen izvršljivosti odločbe še pred nastopom dokončnosti oziroma pravnomočnosti. Ugotovljeno je bilo, da so pravna sredstva potrebna za zagotavljanje pravilnosti (pravne in dejanske pravilnosti) upravnih odločb in da je izvršljivost odločb pred nastopom dokončnosti oziroma pravnomočnosti dopustna zgolj v izjemnih primerih, ko obstaja minimalno tveganje, da odločba, ki se izvršuje, ni zakonita. Ugotovljeno je bilo tudi, da uporaba pravnih sredstev krepi pravno pravilnost in posledično tudi pravno varnost ter da institut pritožbe omogoča izenačitev upravnega odločanja teritorialno organizirane uprave. Na podlagi analize je bilo ugotovljeno, da drugostopenjski organi kljub velikemu številu pravnih sredstev niso pretirano obremenjeni, saj so pravna sredstva uporabljena v zelo majhnem delu vseh upravnih zadev.

Abstract:The right to a legal remedy is a fundamental right and a part of legal order. Consequently, it is also part of the administrative law. It provides different categories of legal remedies, all characterized by their intent to enable fair procedure that ensures valid administrative decision, based on the facts and the law. This raises question, whether more categories and number of legal remedies increase legal correctness and certainty, or they bring uncertainties to acquired rights by enabling more possibilities to challenge them? This thesis is based on the analysis of selected administrative cases. Its purpose was to determine the impact of the decisions taken by the second-instance body on legal correctness of its decisions. Further, it studied the impact of second instance body decisions to the work of the first-instance bodies and what enforceability of these decisions means for a decision before it becomes valid. It also found that the enforceability of decisions before their final validity is admissible only in exceptional cases, when risks of invalidity exist. It concluded that the use of legal remedies strengthens legal correctness and certainty, and that the institute of appeal enables harmonization of decision-making in different territorial administrative units. Finally, it concluded that the second-instance bodies, despite of the large number of legal remedies are not overburdened, as they are applied in a limited number of all administrative matters.
