The right to a healthy living environment in the context of the European Convention on Human Rights

Abstract: Although more than 150 countries recognize the right to a healthy environment in their national constitutions, there is no autonomous, globally recognized human right to live in a healthy environment. Despite the absence of explicit rec-ognition of the human right to a healthy living environment in the international environment, it exists and is developing through the application of already existing internationally recognized human rights to environmental issues. the con-ducted analysis, presented in this Article, implicitly formu-lates the right to a healthy living environment as it stems from the EcHr and the case law of the EctHr. the presented Article is focused on the substantive and procedural aspects of essential EcHr rights that can be implicitly linked to the right to a healthy living environment, while also identifying and defining the most important factors that ensure the ef-fective enforcement and protection of the right to a healthy living environment in accordance with the EcHr. the pre-sented concept of a model of the right to a healthy living environment, as it implicitly derives from the EcHr and the EctHr, offers a broader insight into the right to a healthy living environment, together with extensive, yet fundamen-tal arguments stemming from the case law of the EctHr. Undoubtedly, the results of the conducted analysis contribute to raising awareness and strengthening environmental protection as well as protecting the rights of individuals in relation to the topic at the national level.

Recent climate change litigation before the European Court of Human Rights

Abstract: climate change poses significant threats to human rights, as protected under the European convention on Human rights. the European court of Human rights acknowledg-es the unprecedented challenges that climate change cases present, highlighting the increasing need to address these issues concerning human rights violations. recent climate case litigation before the European court of Human rights highlights key legal principles, including states’ positive obli-gations to protect life and health from environmental harm, including climate change. the landmark case of Verein Kli-maseniorinnen Schweiz marked the first instance where the European court of Human rights identified a human rights violation linked to climate change. this decision sets a sig-nificant precedent, influencing future lawsuits and environ-mental legislation. Although the judgment has limitations, particularly given switzerland’s unique regulatory context, it underscores the increasing role of climate litigation in shap-ing policy and public discourse, extending its impact be-yond the courtroom.

Dynamic interpretation and judicial activism : companions in the protection of convention human rights

Abstract: The authors discuss the dynamic interpretation of the European Convention on Human Rights and the judicial activism of the European Court of Human Rights, which they describe as necessary companions in protecting convention rights. Dynamic interpretation and judicial activism allow the court to respond to societal changes and appropriately develop judicial law. However, as such departures from a formalistic (static, conservative) understanding of convention provisions affect the stability and predictability of the convention legal system, dynamic interpretation and judicial activism must be applied reasonably and balanced with respect for the principles of judicial self-restraint and the rule of law. Furthermore, the court must consider that its decisions and their implementation depend on the level of consensus and political will among the contracting states in certain areas of human rights protection. The European convention on Human Rights and the European court of Human Rights are discussed as two key foundations of the legal and political identity of broader European integration, based on the values of human dignity and the rule of law.

Between individual rights and state responsibility : the role of the State Sttorney's Office as the protector of property and other interests of the Republic of Slovenia before the European Court of Human Rights

Abstract: Drawing on statistical data and the practical experience of its representative, the state Attorney’s Office of the repub-lic of slovenia (state Attorney’s Office), the article examines the performance of the republic of slovenia (slovenia) in proceedings before the European court of Human rights (EctHr). According to the authors, the statistical data—tak-ing into account the particularities of the EctHr’s decision-making process—show that, more than three decades after the convention became binding on slovenia, the country has generally been successful in ensuring the respect and protection of human rights and therefore do not support the occasional allegations that slovenia is a major violator of these rights. Nevertheless, the authors emphasize that slo-venia must not be content with what has been achieved. the ideal of full respect for human rights must accordingly remain the primary goal of all institutions and individuals whose work can influence the level of human rights protec-tion in slovenia. In this aspect the state Attorney’s Office plays an important role as the republic of slovenia’s representative before the EctHr, a proponent of friendly set-tlements, a participant in the execution of judgments, and a legal adviser to state authorities, which it also represents in proceedings before domestic courts. Its role is becoming even more significant in occurrence of new challenges such as climate change, digital technologies, artificial intelligence, and the ongoing need to ensure consistent compliance with the principles of the rule of law. this trend of its increasing pertinence and expanding scope should be reflected in the institutional framework of the state Attorney’s Office, par-ticularly to achieve a greater impact of its advisory function and to enhance international cooperation with representa-tives of other states before courts.

Slovenia's steps on the European path

Abstract: he article discusses the first steps of slovenia on its path toward accession, adaptation, and implementation of the Eu-ropean convention on Human rights and the case law of the European court of Human rights. Although the conven-tion was known under the previous system, its actual part-nership was unattainable in the then political circumstances, as the conditions for membership in the council of Europe were not met and the level of human rights protection re-mained questionable. the former Yugoslavia did submit an application for membership in the council of Europe shortly before its dissolution, but it was never realized. this turning historical period — a time of major social and political chang-es following the decline of soviet influence — encouraged processes of democratization and transformation of values throughout Europe, particularly in its eastern part. For slo-venia, it was a time of exceptional sensitivity due to the war events in the neighbourhood, yet with internal political unityit succeeded in taking a new, democratic path. shortly after independence, slovenia became the first new state in the re-gion to join the Venice commission and to establish partner-ship with the council of Europe, the European convention, and the European court of Human rights. the acceptance of the convention’s values and the court’s case law among the first new or renewed states marked the beginning of a period of adaptation, renewal, and internalization of funda-mental democratic principles throughout slovenian society and the state.

Challenging gender stereotypes in classical ballet pedagogy: perspectives and approaches : master thesis of the study program of the second Bologna cycle Dance studies, dance pedagogy

Abstract: This master’s thesis explores the possibilities for developing ballet pedagogy as a more inclusive, critically aware, and ethically sensitive practice. Based on feminist, queer, and intersectional theoretical frameworks, it analyzes how traditional educational models can contribute to the preservation of normative ideals, particularly regarding gender, sexual orientation, race, and bodily aesthetics. The research is grounded in qualitative methodology and includes interviews with ten dance educators from various cultural backgrounds. The thematic analysis highlights four key areas of pedagogical transformation: gendered embodiment, institutional culture, somatic awareness, and power relations in the learning environment. Rather than rejecting classical technique, the study proposes ways to reinterpret ballet through inclusive pedagogy that foregrounds dialogue, care, and student autonomy. Emphasizing the experiences and identities of dancers, the thesis advocates for a shift from traditional, hierarchical models to more inclusive and responsive approaches. The findings indicate that meaningful change in ballet education requires not only content adjustments but also a thorough reconsideration of how bodies are understood, valued, and taught. Instead of maintaining traditional norms, the thesis proposes a vision of ballet as a space where diverse identities can develop, be expressed, and co-create, whereby ballet becomes a medium of artistic expression and social transformation.

Primerjava meritev sagitalnih krivin hrbtenice, izmerjenih s svinčnico in aparatom za rasterstereografijo Formetric 4D, pri otrocih in mladostnikih : magistrsko delo študijskega programa druge bolonjske stopnje Zdravstvene vede

Abstract: Uvod: Zanesljive in dostopne metode ocenjevanja telesne drže so ključne za zgodnje prepoznavanje posturalnih nepravilnosti. V klinični praksi se pogosto uporablja svinčnica, ker omogoča hitro in enostavno merjenje, medtem ko novejše metode, kot je Formetric 4D, omogočajo natančne, ponovljive meritve. Metode: Analizirani so bili podatki 35 preiskovancev. Primerjani so bili razdalje od navpičnice do procesusa spinosusa C7 (PSC7) in L3 (PSL3) ter sagitalni indeks. Podatki so bili primerjani z normativnimi vrednostmi in analizirani glede na indeks telesne mase (ITM), spol in starost. Statistična obdelava je bila izvedena v programu SPSS 29.0. Statistična značilnost je bila določena pri p = 0,05. Rezultati: Statistično značilna razlika med metodama je bila ugotovljena v nivoju PSC7 (p < 0,001; α = 0,05), medtem ko je v nivoju PSL3 ni (p = 0,252). Sagitalna indeksa dobro korelirata (ICC = 0,864). Prav tako je izračunan interval zaupanja za meritve s svinčnico znotraj intervala zaupanja normativnih vrednosti (NV), ki je enak za oba nivoja meritev (NV = 39,9 ± 16,7 mm; PSC7 = 37,68–48,03 mm in PSL3 = 32,98–41,02 mm). Razprava in sklep: Rezultati so pokazali dobro primerljivost med metodama. Statistično značilne razlike so bile le pri meritvah v cervikalnem nivoju. ITM in starost nista vplivala na meritve, razlike med spoloma pa so se pokazale v cervikalnem nivoju. Ugotavljamo, da bi bila za boljšo primerljivost z drugimi študijami potrebna standardizacija položaja preiskovancev in protokolov merjenja. Ugotovitve potrjujejo pomen uporabe neinvazivnih metod in prednosti kombinacije obeh pristopov za oceno telesne drže, predvsem otrok in mladostnikov.

Education against ageism, stereotypes and gerontophobia about the sexuality of older adults (development of a model for integrated promotion of sexual life of older adults)

Abstract: This study aims to develop an educational model and guidelines for promoting sexual health in older adults (55+), addressing ageism, stereotypes, and gerontophobia. Despite its significance for successful aging, sexual health in older adults is often neglected. The study involved 651 participants (aged 55-75) and used a quantitative approach, examining factors like health status, sexual activity, and education through an online survey. Key findings include a positive correlation between health and sexual satisfaction (r = 0.2 to 0.4, p < 0.001) and the importance of sexual knowledge in life satisfaction (F = 90.027; p < 0.001). Results underline the need for tailored educational programs and open discussions on sexuality. The proposed model aims to improve sexual well-being and overall quality of life, promoting a holistic approach to sexual health care to older adults. These findings are relevant for shaping policies and interventions in Slovenia and globally.Ta študija si prizadeva razviti izobraževalni model in smernice za spodbujanje spolnega zdravja starejših odraslih (55+), pri čemer se osredotoča na vprašanja starizma, stereotipov in gerontofobije. Kljub njegovemu pomenu za uspešno staranje je spolno zdravje starejših pogosto zanemarjeno. V raziskavi je sodelovalo 651 udeležencev (starih od 55 do 75 let), uporabljena pa je bila kvantitativna metoda, ki je s spletno anketo proučevala dejavnike, kot so zdravstveno stanje, spolna aktivnost in izobrazba. Ključne ugotovitve vključujejo pozitivno korelacijo med zdravjem in spolnim zadovoljstvom (r = 0,2 do 0,4; p < 0,001) ter pomen spolnega znanja za življenjsko zadovoljstvo (F = 90,027; p < 0,001). Rezultati poudarjajo potrebo po prilagojenih izobraževalnih programih in odprtih razpravah o spolnosti. Predlagani model je usmerjen v izboljšanje spolnega blagostanja in splošne kakovosti življenja ter spodbuja celostni pristop k spolnemu zdravju starejših. Ugotovitve so pomembne za oblikovanje politik in intervencij v Sloveniji in po svetu.

From the International federation of sports physiotherapy to the International sports and exercise physiotherapy association: celebrating twenty-five years of the International federation of sports physical therapy

Abstract: Over the span of 25 years, the International Federation of Sports Physical Therapy (IFSPT) has grown from its founding in 2000 in the city of Utrecht in the Netherlands to a Federation of more than 40 member organizations. The IFSPT was officially recognized as a member organization of the World Confederation for Physical Therapy in 2003. Since then, it has partnered with the International Journal of Sports Physical Therapy (in 2010), defined the core competencies for sports physiotherapists, launched the pathway to become a Registered International Sports Physical Therapist, and inaugurated its own World Congress in 2015, with the sixth congress planned for December 2026. This perspective reviews these milestones, notes remaining global disparities, and outlines priorities in equity, digital health, and sustainability.
