Title:Posebnosti afriških ustavnih sistemov : magistrsko delo

Abstract:Zgodovina afriškega kontinenta je pestra, kar gre pripisati vzponu egiptovske civilizacije in vplivu kolonialnih sil, ki so kontinent zaznamovale z osvajanji in političnimi oblikovanji državnih ureditev afriških držav. Skupni imenovalec vseh držav je varstvo človekovih pravic. Varstvo slednjih pa povzroča številne pomisleke in dvome, saj vsaka od obravnavanih držav dopušča kot kazensko sankcijo smrtno kazen, zato na afriškem kontinentu obstaja primanjkljaj varstva človekovih pravic. Posebnost afriške celine so plemenska in verska sodišča, ki imajo posebno funkcijo. Taka sodišča dovoljujejo ustavnopravni sistemi Etiopije, Nigerije in Južnega Sudana. Tradicionalno oziroma običajno pravo je na afriškem kontinentu zelo razširjeno. Na ustavni ravni ga najdemo v Južnem Sudanu, kjer je omenjeno kot pravni vir, omenja pa ga tudi etiopska ustava, in sicer v smislu priznavanja uporabe običajnega prava pri sklenitvi zakonske zveze. Sicer pa ga v ustavnih sistemih ostalih držav ni moč najti. V Nigeriji je tradicionalno pravo zmes plemenskih ali običajnih praks, ki jih kot del določene skupnosti priznavajo člani določene skupnosti. V teh skupnostih ima tradicionalno pravo moč zakona. Vse anglofonske države pa so v zvezi z ustavnosodno presojo prevzele ameriški sistem ustavnosodne presoje.

Abstract:Africa's history is very vibrant, which can be attributed to the rise of Egyptian civilization and the impact of colonialists who marked the continent with conquests and political shaping of state systems of African countries. The common denominator of all countries is the protection of human rights. However, the protection of the latter raises a number of concerns and doubts, as each of the countries in question allows the death penalty as a criminal sanction so there is a shortage of human rights protection on the African continent. Customary and religious courts are specific to Africa and have a specific function. Such courts can be seen in Ethiopia, Nigeria, and South Sudan. Traditional law is very common on the whole African continent. It can be found in South Sudan as a legislature source and it is also mentioned in Ethiopian constitution, in terms of recognizing the application of customary law in marriage. In other countries' constitutions traditional law is not mentioned. In Nigeria the traditional law is a mixture of customary practices which are approved by some communities. In those communities traditional law has the true power of law. All Anglophone countires have adopted the American system of constitutional review.
