Title:Vpliv dovoljenja za objekt daljšega obstoja na tržno vrednost nepremičnin : magistrsko delo

Abstract:V Sloveniji je veliko nedovoljenih gradenj, ki jih bodo morali lastniki ustrezno legalizirati, če bodo želeli urediti njihovo pravno stanje in jih prodati. Ena izmed možnosti, ki jih omogoča trenutni Gradbeni zakon, je legalizacija objekta kot objekta daljšega obstoja. S tem načinom legalizacije želi zakonodajalec poenostaviti postopek legalizacije objektov. V magistrskem delu smo z anketnim vprašalnikom preverili mnenja poznavalcev nepremičnin, nepremičninskega trga in gradnje o vplivu legalizacije objekta kot objekta daljšega obstoja na njegovo tržno vrednost, o odločitvi investitorjev za tovrstno legalizacijo in o morebitnih ovirah oziroma pomislekih kupcev ob nakupu. Rezultati ankete kažejo, da se lastniki odločajo za tovrstno legalizacijo zaradi enostavnejšega in hitrejšega postopka ter nižjih stroškov ter da bi objekti daljšega obstoja morali doseči nekoliko nižjo vrednost na nepremičninskem trgu. Pridobljeni rezultati magistrskega dela bodo služili zainteresirani širši javnosti, ki bo prišla v stik z legalizacijo objektov, bodisi kot lastniki pri odločitvi o načinu legalizacije, nepremičninski agenti in projektanti pri svetovanju ali ocenjevalci vrednosti nepremičnin pri cenitvi. Kot kaže, legalizacija objekta kot objekta daljšega obstoja ne bo vplivala na njegovo tržno vrednost, vendar bi temu morali posvetiti več pozornosti.

Abstract:Many buildings without required building permits have been built in Slovenia, but the owners will have to legalize them if they intend to sell them. One of the options offered by the current Building Act is the legalization of the building as a building of longer existence. In this way, the legislator wants to simplify the process of legalization of buildings. In my master's thesis I surveyed a pool of experts in real estate, the real estate market and the construction sector in order to assess the legalization of a building as a building of longer existence on its market value, the investors' decision for such legalization and possible obstacles or concerns of buyers. The results of the survey indicate that the owners are opting for this type of legalization due to a simpler and faster procedure and low costs, and that buildings of longer existence are likely to achieve lower value on the real estate market. These findings will serve the general public interest, which will come into contact with the legalization of buildings. It appears that, the legalization of a building as a building of longer existence will not affect its market value, although it should be given greater attention.
